As a service to its members, NCUIH tracks and monitors the development of relevant regulations and proposed agency actions that impact Urban Indian Organizations or directly affect their operational growth, financial structure and service expansion. A corollary of regulatory powers in the Executive branch of government is when the President of the United States issues executive orders and presidential memoranda instructing one or more agencies in the Federal government to take some concrete action.
The below document provides a summary of key executive orders & other Regulatory Actions. The NCUIH FEDERAL REGULATIONS TRACKER is a formatted table that will list on a continuing basis, pertinent information to UIO’s as described above. It is not inclusive to all regulatory changes and is not intended to be a suggestion for action but rather a source of information.

Agency Actions (archival): The Deputy Assistant Secretary for Human Services Policy with the HHS writes to invite Tribal leaders to discuss the HHS' Equity Action Plan. Summary:The Equity Action Plan is part of the HHS’ efforts to implement the President’s Executive Order on “Further Advancing Racial Equity and Support for Underserved Communities Through The Federal Government,” which reaffirmed the Administration’s commitment to deliver equity and build an America in which all can participate, prosper, and reach their full potential. HHS is inviting Tribes to share feedback on the Plan’s priority areas and to hear Tribal leaders’ thoughts and concerns.
Analysis / Additional Details:The virtual Tribal Consultation will take place on April 29, 2023, from 2:30 to 4 PM Eastern. To help plan, HHs invites written questions or comment comments to consultation@hhs.gov. A 30-day written comment period will be available after the virtual consultation.

Agency Actions (archival): The IHS Director writes to invite Tribal and UIO leaders to join a series of four Tribal Consultations and Urban Confer session in calendar year 2024 on Health IT Modernization. Summary:IHS is holding the meetings to ask questions and receive feedback from Tribal and UIO leaders. During the second event scheduled for May 9, the IHS provide information on and received feedback concerning deployment and cohort planning.

Agency Actions (archival): The Veterans Health Administration (VHA) and the Indian Health Service (IHS) are writing to request your recommendations on the Draft Annual Operational Plan for fiscal year (FY) 2024 and to share the completed FY 2023 VHA-IHS Memorandum of Understanding (MOU) Operational Plan. This updated plan was based on collective input from a series of Tribal Consultation and Urban Confer sessions held in September and October 2022. Summary:The next round of Tribal Consultation and Urban Confer will be held in the spring of FY 2024. We will convene a joint in-person Tribal Consultation and Urban Confer session that will be held on Monday, April 15, 2024, during the Tribal Self-Governance Conference at the Gila River Indian Community’s Wildhorse Pass Resort in Chandler, Arizona.

Agency Actions (archival): Tribes, Tribally Designated Housing Entities and Tribal Housing Authorities Public Engagement Listening Session on HUD’s Draft 2024-2028 Environmental Justice Strategic Plan Summary:The U.S. Department of Housing and Urban Development (HUD) is in the process of developing its 2024-2028 Environmental Justice Strategic Plan. The Department is inviting Tribal leaders and representatives to participate in the Department’s upcoming public engagement listening session on the development of the Strategic Plan. This is an opportunity for tribal representatives to hear specifics from HUD officials regarding the development of the Environmental Justice Strategic Plan and to provide feedback on the priorities HUD should consider in the development of this strategic document. During this listening session, HUD will provide an update on the development of the strategy and engage with tribal representatives regarding the desired outcomes of the strategic plan. HUD will also ask open-ended questions so as to hear from those who attend on their specific feedback, opportunities, and concerns related to environmental justice within Tribal communities that may improve the strategic outcomes of the document and its priorities.

Agency Actions (archival): The Department of Veteran Affairs (VA) would like to invite facility Leaders (or their representative designee) to an Urban Confer regarding VA’s Reimbursement Agreement Program (RAP). Summary:The VA would like to enhance the current UIO RAP and is proposing the adoption of a revised Agreement template. The revisions seek to expand the scope of reimbursable services, remove the VA’s quality oversight, lengthen timely filing, and generally streamline the Agreement.

Agency Actions (archival): The IHS Director writes to Urban Indian Organization Leaders to provide the fiscal year 2024 allocation, eligibility requirements, and procedures to access the Urban Emergency Fund (UEF). Summary:The UEF is a limited, discretionary allocation fund managed by the IHS Office of Urban Indian Health Programs (OUIHP) to address some of the costs incurred during one-time, non-recurring emergencies and disaster relief efforts involving Urban Indian Organizations (as defined by 25 U.S.C. § 1603(29)). Each fiscal year, the OUIHP allocates up to $200,000 to the UEF. Funding is not guaranteed and is subject to the availability of appropriations.

Agency Actions (archival): Submission for Office of Management and Budget Review; Tribal Child Support Enforcement Direct Funding Requests: (Office of Management and Budget #0970-0218) Summary:The Office of Child Support Services (OCSS), Administration for Children and Families (ACF) is requesting to extend approval of revisions to an approved information collection the Tribal Child Support Enforcement Direct Funding Requests (Office of Management and Budget (OMB) #0970–0218). These revisions were approved under an emergency approval for 6-months and included a new requirement for Tribes or Tribal organizations to provide that charging fees and recovering costs will not be permitted.
